End User License Agreement

This End User License Agreement (“EULA”) is a contract between you and ViajAI regarding the use of the ViajAI application (the “Licensed Application”) on iOS and Android devices. For downloads from Apple’s App Store, unless stated otherwise, Apple’s standard Licensed Application EULA also applies and prevails in case of conflict with this document.

1. Scope of license

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Licensed Application on devices you own or control, for personal, non-commercial use, in accordance with the usage rules of the corresponding app store (App Store or Google Play).

2. Restrictions

• You may not copy, modify, distribute, sell or lease the Licensed Application.
• You may not decompile, disassemble or reverse engineer it, except to the extent permitted by applicable law.
• You may not circumvent security measures or use the Application in ways not intended by these terms.

3. Data and privacy

Use of the Application involves the data processing described in our Privacy Policy, which forms an integral part of this EULA.

4. External services and AI content

The Application uses third-party services (authentication, AI models, place information, affiliate links to flights and hotels). AI-generated content is informational and may contain errors; always verify important information with official sources. We do not guarantee continuous availability of external services.

5. Maintenance and support

Maintenance and support of the Licensed Application is the sole responsibility of ViajAI. Apple has no obligation whatsoever to furnish maintenance or support with respect to the Application. For support, write to soporte@viajai.cl.

6. Apple as third-party beneficiary

For App Store downloads: Apple and its subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary. In the event the Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the Application.

7. No warranty

The Licensed Application is provided “as is”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by applicable law.

8. Limitation of liability

To the maximum extent permitted by law, ViajAI shall not be liable for indirect, incidental, special or consequential damages arising from the use of or inability to use the Licensed Application.

9. Export compliance and sanctions

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Termination

This EULA is effective until terminated by you or ViajAI. Your rights terminate automatically if you breach any of its terms; in that case you must cease all use of the Application.
