End User License Agreement

This Agreement governs your use of ViajAI as a progressive web app (PWA) and as an iOS app distributed through Apple’s App Store. It supplements the Terms & Conditions, which apply to anything not covered here.

The licensor is Pedro Giovanni Kara Carmo (Chilean tax ID 21.733.782-8, California 2468, Providencia, Chile). Apple is not a party to this Agreement and has no responsibility whatsoever for the application or its content.

1. Right of use

We grant you a limited, personal, non-exclusive, non-transferable and revocable right to use ViajAI for lawful, personal purposes while you comply with this Agreement. On iOS the licence is additionally governed by Apple’s Licensed Application End User License Agreement and is valid on any device you own or control, under App Store usage rules.

2. Requirements

You must be 18 or over to use ViajAI. The app requires an internet connection; without one, key features are limited or unavailable.

3. Restrictions

• Do not copy, sell, rent or sublicense the application.
• Do not circumvent security controls, quotas or access limits.
• Do not scrape data automatically or interfere with other users.
• Do not reverse engineer, except to the extent the law permits despite this prohibition.
• Do not use the application to train third-party artificial intelligence models.

4. Content and AI

AI-generated itineraries are indicative and may contain errors: outdated prices, closed venues or incorrect entry requirements. Always verify visas, documents and health requirements against official sources before travelling. Do not upload content you have no rights to.

5. In-app purchases (iOS)

On iOS, paid plans are offered as in-app purchases processed by Apple:

• The price and currency are whatever the App Store displays at the time of purchase.
• Payment is charged to your Apple account on confirmation.
• ViajAI+ is an annual auto-renewing subscription. Apple will charge the renewal within the 24 hours before the end of each 12-month period unless you cancel first.
• To stop it renewing, cancel at least 24 hours before the renewal date, in Settings → your name → Subscriptions. Managing the subscription is your responsibility; deleting the app does not cancel it.
• The Pass is a one-off payment, not a subscription: it does not renew.
• Refunds for iOS purchases are handled by Apple under their own policy. See Refunds.

6. Data and privacy

How we handle your data is described in the Privacy Policy and the Cookie Policy. The app requests camera, photos, microphone, speech recognition and notification permissions only when you use the corresponding feature, and it works if you deny them, with that feature limited. ViajAI does not request access to your location or your contacts.

7. Updates and maintenance

The PWA updates automatically; the iOS app updates through the App Store. We may modify or suspend features for maintenance, security or product evolution. Support and maintenance are solely our responsibility, not Apple’s, and are provided through soporte@viajai.cl.

8. Warranties and claims

ViajAI is provided “as is”, with no warranties beyond those required by Chilean law and, where applicable, by the consumer protection rules that cover you.

On iOS, if the application fails to conform to an applicable warranty, you may notify Apple, who may refund the purchase price. To the maximum extent permitted by law, Apple will have no other warranty obligation. Any other claim for breach of warranty, product liability, third-party intellectual property infringement or regulatory non-compliance is our responsibility and not Apple’s.

9. Third-party beneficiaries

Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you as a user of the iOS app.

10. Export compliance

You represent that you are not located in a country subject to a United States government embargo and are not listed on any restricted-party list.

11. Termination

You may terminate this Agreement by deleting your account and uninstalling the app. We may suspend access for breach, abuse or security risk. Remember that deleting your account does not cancel a subscription bought through Apple: cancel it in Settings as well.

12. Governing law and contact

Chilean law applies, without prejudice to any non-waivable rights the consumer rules of your country of residence give you. For support or questions about this licence: soporte@viajai.cl.
